Tips to submit 2nd Appeal Application under RTI Act- 2005

  1. When to submit the 2nd Appeal Application:
  • If you are not satisfied with the judgment of First Appellate Officer,
  • If you think supplied information by Public Authority is incomplete, misleading or false,
  • If either Public Information Officer (PIO) and/or First Appellate Authority (AA) has rejected your application to supply the information,
  • If Appellate Authority have didn’t given any judgment within specific time limit,  
  • If Assistant Public Information Officer has rejected to accept or forward the application to State/Central Public Information  Officer or State/Central Information Commission,
  • If you think sought application fee by Public Authority is unreasonable under Right to Information Act 2005.
  1. Where to submit 2nd Appeal Application:
  • In the office of State Information Commission (SIC) (if matter related to State’s Public Authority),
  • In the office of Central Information Commission(CIC) (if matter related to Central’s Public Authority),
  1. Time-limit for 2nd appeal:
  • Within 90 days from the date of expiry of the prescribed period or from the receipt of communication (judgment or rejection of request) from the First Appellate Authority,
  • If the State/Central Information Commission is satisfied that the appellant was prevented by sufficient cause from filing the appeal, the appeal may be admitted after 90 days also.
  1. Drafting an Application for 2nd appeal:
  • Draft your application on white paper or download that from India Development Gateway Portal
  • Application can be handwritten or typed,
  • Application should be submitted in English or Hindi (in the case of Central Information Commission) or in any state languages (in the case of State Information Commission
  1. Preparation of Application Form:
  • Provide required information clearly in the specified format,
  • Make a index page to indicate the list of enclosures with page number,
  • Prepare five copies of all documents (i.e. 2nd appeal application, Request for information, 1st appeal application, proof of fee paid to PIO etc) and self attested it. You can make one extra copy for yourself.
  1. How to send the application:
  • Application should be sent in five (5) copies by Registered Post Only
  • Also, attach Acknowledgement Card with application.
  • In the case of Central Information Commission, application can be submitted online. CLICK HERE to submit your application online. 
  1. Time limit for the supply of information:
  • In normal case decision should be given in 30 days, but exceptionally it could be 45 days.
  • Time limit of decision will be count from the date of receiving the application by Central/State Information Commission.
  1. Judgment of State/Central Information Commission shall be binding to both parties. But, aggrieved Public Authority can appeal in High Court against the State Information Commission/Central Information Commission judgment.
