Tips to submit 1st Appeal Application under RTI Act- 2005

  1. When to do the First Appeal:
  • If Public Information Officer (PIO) has rejected your application to supply the sought information,
  • If Public Authority unable to supply information within time limit of 30 days or 48 hours*
  • If Public Authority have not appointed Assistant Public Information Officer/Public Information Officer to receive the application or to supply the sought information,
  • If Assistant Public Information Officer has rejected to accept and forward the application to Public Information Officer
  • If you are not satisfied with the judgment of Public Information Officer
  • If you think supplied information is incomplete, misleading or false,
  • If you think sought application fee is unreasonable under Right to Information Act 2005.
  1. Time limit for filing of first appeal application:
  • Within 30 days from the date of expiry of the prescribed period or from the receipt of communication (judgment or rejection of request) from the State Public Information Officer (SPIO) /Central Public Information Officer (CPIO)
  • If the First Appellate Authority is satisfied that the appellant was prevented by sufficient cause from filing the appeal, the appeal may be admitted after 30 days also.
  1. Drafting the first appeal application:
  • Draft application on white paper or download that Application Form from India Development Gateway Portal
  • Application should be handwritten or typed,
  • Application should be written in English, Hindi or any state languages,
  • Provide required information clearly in the specified format,
  • Enclose self attested Xerox copy of request application with the proof of application fee, receipt of application by Pubic Information Officer, Judgment copy etc,
  • Make a Xerox copy of application and all attached document for your further reference.
  1. Where to submit the First Appeal Application:
  • It has to be submit in the office of First Appellate Authority in the same Public Authority,
  • In hierarchy, First Appellate Authority is senior officer than Public Information Officer and responsible to receive the application, supply sought information or reject the application,
  • Before submit the 1st appeal application, check the name of First Appellate Authority, specified fee and mode of fee payment (Some states have made provision of free of cost 1st appeal wherever some state charging application fee).
  1. How to send the 1st Appeal Application:
  • Application should be submitted by hand or post.
  • In case, you are sending the application by post then use only registered post service. Always avoid courier service.
  • In both cases get the receipt of sending or submitting the application.
  1. Time limit for the supply of information:
  • In normal case decision should be given in 30 days, but exceptionally it could be 45 days.
  • Time limit of decision will be count from the date of receiving the application by First Appellate Authority (FAA).
